In this course, we cover the defence of not criminally responsible on account of mental disorder. We begin with a discussion of who should raise the issue, and when, and how to order an assessment. The procedure of the assessment is outlined, with attention given to the psychiatric assessment and information that should be relied upon. The conditions that do, and do not, justify an NCR defense are explained in detail. Lastly, we examine what happens once NCR is found, depending on whether the accused is judged to be high-risk.
