In this course, we review possible reasons for terminating a client-lawyer relationship from both the perspective of the lawyer and the client, with a focus on the former.
We discuss the circumstances in which it is prohibited to withdraw from a case, when it is mandatory, and when it is optional.
We then outline the process of withdrawal, taking into account how much notice to give the client, and what form it should take, and applying for leave from the court.
Lastly, we examine the relationship between Cunningham, the ethical code rules, and the rules of the court.
